PIL regarding drug abuse in J&K

Jammu, July 28: In a Public Interest Litigation filed by Arthav Mahajan a student of law seeking initiation of a special drive by J&K police in the entire state for checking the growing menace of drugs amongst youths and regarding Low conviction in NDPS Case.
A Division Bench of State High Court Comprising Acting Chief Justice Alok Aradhe and Justice Sanjay Kumar Gupta after hearing Advocate Deepika Mahajan appearing for the PIL, granted two weeks time to comply the direction issued on April 18, 2018 whereby Division Bench directed Principal Secretary to Government, Home Department, J&K to file a status report indicating whether there is any Forensic Science Laboratory (FSL) specifically meant for Jammu, Srinagar and Ladakh Province for Narcotics and if not, what are the steps taken to establish the same. A time bound stand shall be submitted to this Court on the next date of hearing.
Earlier Division Bench also directed Zonal Director, Narcotics Control Bureau, Jammu to coordinate with the SSP, Jammu, namely, Vivek Gupta and ensure strict compliance of the law and also prompt action against the offenders after proper investigation so that the resultant criminal trials does not end in acquittal on account of improper investigation by the authority.
When the PIL came-up for hearing, Division Bench headed by Acting Chief Justice Alok Aradhe observed that Adv Deepika Mahajan appearing for the PIL submits that the respondents have not complied with the directions contained in the order dated 18.04.2018 in letter and spirit and the compliance report has been filed with regard to one of the directions contained in the order. It is also pointed out by counsel that the Police Department has undertaken one programme, namely, Sanjeevani to deal with the drug menace in the State. Upon this Division Bench granted two weeks' time to enable AAG to comply with the directions issued vide order dated 18.04.2018 as well as to apprise this Court with regard to action taken by the Police Department for de-addiction of drug addicts, under the programme, namely, Sanjeevani.
