Principal Sessions Judge Samba convicts accused in NDPS case

JAMMU, Sept 22: The Court of Principal Session Judge Samba today convicted an accused in a case under FIR number 55 /2011 under Section 8/21/22 NDPS Act of Police Station Ramgarh with fine of Rs 10,000 and further in default of fine, the accused will undergo 2 months imprisonment.
Pertinently on August 7, 2011, a Police Party of Ramgarh while on Naka duty at Chak Salaria, Ramgarh intercepted a person who was moving under suspicious circumstances and during frisking a polythene bag containing 90 capsules of Paravan spas was recovered from his possession.
The accused person disclosed his identity as Surjeet Singh of Koulpur Tehsil Ramgarh, Samba.
Taking cognizance into the matter, the instant case was registered under relevant Sections at Ramgarh police station.
During the trial the Court of Principal Session Judge Samba has found sufficient evidences connecting the accused with crime.
Thus prosecution has able to prove the case by clear and sufficient evidences under Section 8 (iii) of NDPS Act punishable under Section 21 of the said Act and accordingly the accused held guilty and convicted for the commission of offence under Section 8/21/22 NDPS Act. The accused is therefore, fined Rs 10,000 and in default of fine, the accused will undergo 2 months imprisonment.
In view of the fact that accused is stated to be the consumer of drug and not a trader and is stated to be given to consumption of drug intoxicating habit as such it will proper to send him to prison who is directed to be released on furnishing surety bond of Rs 25000 for maintaining the good behaviour for 6 months and in the event of repeating the offence by carrying the drug he will be called upon by the court to pay fine and suffer the imprisonment in default.
