DB orders closure of illegal stone crushers

JAMMU, Nov 10: A Division Bench of State High Court Comprising Justice Ali Mohammad Magrey and Justice Sanjeev Kumar in a Public Interest Litigation directed the deputy commissioner Kupwara to ensure closure of the stone crushers still operating in Kupwara .
The direction came after the court perused a report by the Pollution Control Board attesting as "illegal" some stone crusher units operating in Kupwara district despite orders of their closure.
When the court asked senior additional advocate general B A Dar whether the stone crushers were still operating, he said that he was not sure about their closure.
"We deem it necessary to ask the deputy commissioner Kupwara to personally visit the spot and report about the actual position as regards the closure of the aforesaid units," the court said, directing the DC to file status report by December 4. In 2014, the High Court had ordered closure of stone crushers and hot mix plants along Nallah Mawar in Kupwara district.
The court had pointed out that the units were set up on kahcharai and Abi Awal land and the parameters had been violated with impunity.
With regard to the policy required to be framed by the state government for setting up the 'stone crusher zones' or 'zones for hot mix plants', the court had been informed that a committee headed by the Chief Secretary along with the Secretaries of concerned departments was constituted for the said purpose.
