High Court displeased over non implementation of Court directions

JAMMU, Nov 19: Justice Tashi Rabstan took serious note of casual approach of the Govt in implementing directions passed by the court and directed Chief Secretary of J&K to take effective steps for ensuring compliance of directions/orders of this Court. This significant order has been passed in a contempt petition filed by Kiran Sharma.
Justice Tashi Rabstan after hearing Adv Sudershan Sharma appearing for the petitioner whereas AAG Ravinder Gupta appearing for the State, observed that Vide order dated April 7, 2018, granted two weeks' time as last indulgence to the respondents to file compliance report, failing which CS was directed to appear in person before the court on 26.04.2018. On 04.05.2018 time vas again extended by this Court for filing compliance report and personal appearance of the respondent was also exempted, however the Drawing and Disbursing Officer concerned was directed not to release the salary of respondent for the month of May, 2018 till further orders.
Justice Tashi Rabstan observed that despite lapse of more than five years, judgment dated 02.01.2013 has not been complied with and in this backdrop today Mr. Ravinder Kumar Gupta, learned AAG is requesting for extension of time for compliance of the direction dated 02.01.2013. It clearly indicates the non-seriousness of the respondent-department in complying with the directions/orders issued by this Court.
Court further observed that in contempt petitions delay in implementing the directions issued by this Court is increasing day by day which is mainly attributable to the causal approach of the Government-respondents and their non-seriousness is detrimental to public interest.
Therefore, the Commissioner / Secretary to Government, School Education J&K Jammu is directed to appear in person before this court along with compliance report on the next date of hearing.
