HC directs DGP to shift SHO Bandipora

Srinagar, May 14: Taking serious note of non-compliance of its order by Station House Officer (SHO) Bandipora, the High Court has directed the Director General of Police to shift the SHO and report compliance on the next date of hearing.
The direction was passed by Justice Ali Mohammad Magrey in a habeas corpus petition in which the court on April 16 had directed the SHO Bandipora to produce the respondents 6 and 7 before the court on the next date of hearing, that, May 14. The direction was not complied with. Report of Registry reveals that copy of the order was provided to the counsel for the respondents and notice for appearance of SHO Bandipora was served on the Senior Superintendent of Police, Bandipora on April 22. The High Court took serious note and observed that the Superintendent of Police, Bandipora, has adopted a casual approach in implementing the orders passed by this court. Therefore, he shall submit his explanation on affidavit as to what steps he has taken for implementation of the order. "Since SHO Police Station, Bandipora has not complied with the directions of this court, therefore, prima facie he has committed contempt, as such, notice shall be issued to him to show cause as to why he shall not be punished for contempt of court," the court observed. It further directed Senior Superintendent of Police, Bandipora, to seek appearance of SHO Police Station, Bandipora as also Respondents 6 and 7 before the court on the next date of hearing.
