JAMMU, June 6: In a Public Interest Litigation (PIL) filed by Citizen Forum regarding de-congesting and widening of the Ambphalla - Janipur road viz a viz de-congesting and widening of the Janipur - High Court Road, a Division Bench (DB) of the State High Court said that the Government is still found struggling for answers and an action plan to de-congest the these roads.
The petition was filed by Citizen Forum through its President RK Chadha seeking the status of fly-over project from Shakuntla Cinema to Janipur proposed in 2008 which has been abandoned for some extraneous reasons while it also sought to know the steps taken to undertake the widening of the Ambphalla - Janipur road viz a viz de-congesting and widening of the Janipur - High Court Road
The DB comprising Justice Dhiraj Singh Thakur and Justice Sindhu Sharma after hearing Adv Aditya Sharma for the PIL whereas AAG Amit Gupta for the State, observed that Public Interest Litigation has been pending before this Court since 2013 while the state government is still unresponsive.
DB believes that there is enough talent in the higher echelons of the Government and would be expected to take positive action on the subject at the earliest. However, we have been disappointed to know that it has taken the Government six long years and still we see no solution to the ever increasing traffic congestion problems, which people suffer every day travelling the distance on these roads and a considerable amount of money has been spent by the Government towards payment to the organization, namely, RITES to prepare a mobility plan. However, there is no decision taken to even identify the funding sources also comes as a surprise.
DB further observed that this Court do not understand why the Government lacks the will to find a solution to the problem which borders on sheer helplessness. A simple issue as regards widening of the existing roads on the aforementioned sectors also has not been addressed by the Government.
DB further hope and believe that those who at are the helm of the affairs would address this problem at the earliest with a view to alleviate the difficulty, which citizens suffer on a day to day basis and directed Chief Secretary to constitute a committee which will consist in addition to himself, Commissioner Secretary, Public Works Department, Commissioner Secretary, Finance and Commissioner Secretary, Planning to take a final decision in the matter in regard the shifting of utilities on the Janipur High Court Link Road and the payment to the Power Development Department (PDD) for making such a shifting possible, to consider the reports furnished by the RITES to put in place a futuristic mobility plan as suggested by RITES and also to consider the widening of the existing road as suggested in the proposal prepared by the PWD, pending execution of the Metro project.
DB further directed a status report of the first meeting with regard to the first deliberations to be held by the aforesaid Committee be filed after a period of six weeks.
When the PIL came-up for hearing, DB observed that compliance report has been filed by the Chief Engineer, Public Works Department (PWD), wherein it is stated that the proposal with regard to the construction of a Metro in the Ambphalla to Janipur sector is to be considered and evaluated by the Housing and Urban Development Department. It is also stated that an outlay of Rs 40,000 crores would be required for the said mobility plan both for the cities Jammu and Srinagar and that the authorities have yet not identified the funding agencies to execute the project. It is further stated that the PWD on its own has initiated a preliminary project report to de-congest the road from Ambphalla to Janipur for widening and extending road from two lanes to four lanes at an estimated cost of Rs 144.69 crores. It is stated that the said proposal is under process for being submitted to the Government for taking a view on the same.
