Termination of NHM employees revoked
But no salary for suspension period

Kishtwar, June 8: In the wake of High Court directions, the Mission Director National Health Mission (NHM) on Saturday ordered immediate revocation of termination of around 400 such employees who were terminated in February 2019 because of unauthorized absence from duties.
The Mission Director NHM, vide order No. SHS/NHM/J&K/3803-3849, dated 8-06-2019, directed all Deputy Commissioners of the state to revoke the termination orders of all the NHM employees subject to the condition that they will submit an affidavit dully attested by Judicial Magistrate affirming that they shall not claim any remuneration for the period during which they have not rendered their services.
The terminated employees have further been asked to submit an undertaking that they will neither associate themselves with any anti-government organization, nor be party of any programme or activity affecting the delivery of health care system or preventing the department from due discharge of its assigned duties and functions.
In April 2019, Justice Sanjeev Kumar of J&K High Court had passed an order against the order impugned dated 16.02-2019 passed by Deputy Commissioner Kishtwar who is also chairman District Health Society whereby the services of NHM employees of block Dachhan were terminated on the ground of unauthorized absence due to strike.
The 29 petitioners had approached the High Court through Advocate Faheem Shokat Butt challenging their termination which they said was ordered without complying with the procedures established under law and moreover in some other districts, the termination orders of NHM employees were revoked.
After hearing the learned counsel for petitioners and Advocate H A Siddiqui, senior A.A.G appearing for the state, the High Court while issuing notice to the respondents had directed them to file objections indicating clearly as to whether the respondents have any uniform policy to deal with the NHM employees who were terminated by their respective district societies for remaining unauthorized absent in connection with the strike.
