AJKOBC hails UT status to State

Jammu, Aug 11: A meeting of All J&K OBC people, was held in New Plot Jammu to appreciate the conversion of J&K State into a UT as welcome step. All members opined that good governance and better infrastructure shall be ensured now. This step will go a long way to deliver justice to POK / West Pak Refugees, women Rights and rights of SC/ST/ OBCs. All OBCs feel that rule of law shall prevail now. But one issue of OBC reservation appears unresolved. The major points to which kind attention of Govt of India is drawn are including in all states/UTs, all over India, reservation to OBCs is 27% whereas in J&K , it is only 2%. Populakm of OBCs is 32% in J&K as per the census of 1931(Documentary record is available with OBC Development Board). This quota of 2% is not based on the actual population of OBCs. This issue is pending since 1993. Now, when the state of Jammu and Kashmir has been converted into a Union Territory. most of the state laws/ acts are being replaced by the central Govt laws. But it has been noticed that state reservation act 2004 has been kept as such in UT of J&K. This act was enacted in violation of all the criteria laid down by Hon'ble Supreme Court of India using special powers under article 370. State has not implemented 27% quota for OBCs as recommended by MandaJ Commission due to presence of Article 370. Instead of 27%, the State has given only 2% reservation to OBCs.
