No major changes in Transport laws under J&K Reorganization Act

srinagar, Oct 29: As per the Jammu and Kashmir Re-organisation Act 2019, there will be no major changes in Transport laws, while as many laws are replaced by Centre's Act.
The centre government abrogated Article 370 on August 5, which used to provide special status to Jammu and Kashmir which bifurcate the region into two separate Union Territories and paid way for implementation of various centre laws into the state.
There are five major acts in J&K Transport Law, which includes Central Motor Vehicles Act 1988 and Road Transportation Corporation Act 1950, which are concurrent laws. Besides, there are three more acts including Motor Vehicle Taxation Act 1957, Passenger Taxation Act and recently implemented Act of Road and Safety Counsel Act 2018 which falls among the 176 state laws kept intact in Jammu and Kashmir Re organisation Bill 2019.
An official said "We are already following Central Laws in the state and any change in the laws by the Centre government would directly bearing on the laws applicable in J&K".
It is pertinent to mention here that "Due to concurrence of Jammu and Kashmir state transport laws with Central Laws recent penal provisions and increased amount of penalties under Central Motor Vehicle Act 1998 were automatically implemented in J&K".
An official said "There is going to be no change at all in Road Transportation Corporation Act of 1950 under which State Road Transport Corporation (SRTC) is governed. While as, earlier private vehicles had to pay Rs 6000 as one time tax, while commercial vehicles were charged tax quarterly or annually. The change had also become a major bone of contention between transporters and the government".
He added that recently on August 1, this year, under SRO 492, the government had amended Motor Vehicle Taxation Act 1957, making it mandatory to pay nine percent of total cost of the vehicle including private and commercial vehicles, as one time tax as it was done to bring Jammu and Kashmir in sync with other parts of country.
