Court acquits accused in alleged fraudulent withdrawal of migrant relief

JAMMU, Oct 31: 2nd Additional Sessions Judge Jammu VS Bhou acquitted Inderjeet Singh son of Makhan Singh, Hussain Baksh, Chaman Lal Sharma, Majid Hussain and Bua Ditta Choudhary, Jammu in alleged case of fraudulent withdrawal of migrant relief, as prosecution miserably failed to prove its case.
2nd Additional Sessions Judge VS Bhou after hearing Sr. Adv V.R. Wazir and Advocates Ashok Kumar Basotra, Vikram Rathore, S. Manohar Singh & for the accused persons observed that prosecution has miserably failed to prove the ingredients of alleged offences against the accused persons because the evidence is inconsistent, contradictory inter se the prosecution witnesses and there are legal flaws in the case as well.
With these observations, Court is of the considered opinion that the prosecution has failed to fulfill the ingredients of offences alleged against the accused persons, who faced trial beyond reasonable shadow of doubt. During pendency of the trial accused Hans Raj died and even before filing charge sheet accused Kanwal Nain Singh had died on 28.12.2004. The benefit of doubt goes to the accused. -JNF
