Court rejects bail of alleged heroin smuggler

JAMMU, Dec 16: 1st Additional Sessions Judge Jammu YP Kotwal rejected the bail application of alleged heroin smuggler namely Gurmeet Singh who was booked by the police in FIR NO 132/2019, offence under Section 8/21/22 NDPS Act.
1st Additional Sessions Judge Jammu YP Kotwal after hearing APP Harminder Singh for the state prosecution case against the accused is that on 11.11.2019 while the police party was performing patrolling duty, they noticed a person near Bhargav Restaurant Gangyal carrying a bag along with him, on suspicion they stopped the accused and started checking. During checking, police party recovered a bag containing 100 gms of heroin, cash amount of more than one lac rupees, foil paper, weighing machine and a lighter from the conscious possession of accused/applicant.
Court further observed that in the light of the averments made by the Prosecution and the report filed by the police and in my considered view it cannot be said that there are reasonable grounds for believing that the accused/applicant herein is not guilty of the offence with which he has been charged as such the accused cannot be admitted to bail in view of the bar created under section 37 of NDPS Act, hence bail is rejected. -JNF
