Police file charge sheet against Hashim Quershi, five others

SRINAGAR, Dec 25: After a gap of over 11 years, Jammu and Kashmir Police has presented a charge sheet against Hashim Qureshi and five other people for holding a protest which according to police had turned violent in 2008.
Hashim Qureshi is the founding member of Jammu and Kashmir Liberation Front and is the chairman of Jammu Kashmir Democratic Liberation Party (JKDLP).
A top police official said, "Hashim Qureshi and five other people had protested at Nishat in 2008, which had turned violent. And, Police Station Nishat here in Srinagar city had filed a charge sheet against Democratic Liberation Party Chairman Hashim Qureshi and five persons for holding a protest".
The police have named six accused in the charge sheet which include chairman Democratic Liberation Party Hashim Qureshi, Mushtaq Ahmed Wani, Bilal Ahmed Bhat, Mehrajuddin Bhat, Abdul Majid Lone, and Ajaz Ahmed Bhat.
Meanwhile, police in its charge sheet have claimed that an FIR vide number 38/2008 under section 336,148, 341,427, 323 was registered against 6 accused of resorting to violence.
The charge sheet that was filed in the court of Chief Judicial Magistrate Srinagar states that the protest organized by the accused in Nishat area of Srinagar turned violent after a youth who participated in it pelted stones on police.
Meanwhile, Advocate Babar Qadri, who represented the accused, said that he has made his remarks with Chief Justice Magistrate and argued that under State and Central laws, police can't file charge sheets after the lapse of 11 years. He said that under Central Law, police can file a charge sheet within the 7 years while it is 3 years under State Laws.
Qadri further said that after hearing the arguments, the Chief Justice Magistrate has transferred the case to City Judge Srinagar.
