Court directs SHO P/S Channi to register FIR against Reliance Jio, others

JAMMU, Jan 6: Railway Magistrate Jammu Parvaiz Iqbal directed SHO Police Station Channi Himmat to register FIR against Reliance Jio through its Managing Director and Pawan Kumar Sharma for fraudulently issuing Call Detail Record (CDR) of complainant's mobile phone.
This significant direction has been passed in an application filed by Bandhna Sharma wife of Pawan Kumar Sharma R/o HNo 72, Sec 2, Aap Shamboo Temple Road JDA Housing Colony, Upper Roop Nagar, Jammu has prayed for direction to the Police under Section 156 (3) CrPC for registration of FIR on account of breach of privacy by her husband in connivance with Reliance Jio. The applicant is wife of the accused but their relationships are not cordial. They are engaged in multiple litigations before the court of law. It has been alleged by the applicant that the accused no l in connivance with Reliance Jio Staff Management fraudulently took Call Detail Record (CDR) of her mobile phone in brazen violation of the provision of Indian Telegraph Act and Information Technology Act, 2000. Accused no 2 has breached privacy by disclosing her call details and locations etc which warrants Penal action against them. She has stated that the matter was reported to SHO P/S Channi Himmat, Jammu but the officer till date has not taken cognizance, nor FIR has been registered. The applicant reported inaction on the part of SHO P/S Channi Himmat, Jammu to SSP Jammu but till date concrete action has been taken. The applicant has supported his allegations with an affidavit duly sworn before a Magistrate and has placed on record a copy of application made to the SHO and SSP, Jammu and also a copy of the leaked Call Detail Record (CDR).
Special Judge Railway Magistrate Jammu after hearing Adv Tarun Sharma appearing for the complainant, observed that the application discloses the commission of cognizable offence which needs to be probed and directred SHO P/S Channi Himmat, Jammu to register FIR to look into the allegations and conduct investigation under law. He shall report compliance report within one week. JNF
