JAMMU, Jan 6: The Court of Chief Judicial Magistrate Jammu today seeks compliance report from the Chief Engineer, Maintenance and Rural Electrification (M&RE) Jammu in respect of execution of petition titled Kulwant Singh Vs Chief Secretary and others. In pursuance to a personal appearance of the concern Chief Engineer for not implementing the execution order dated 29th November 2008, the counsel Vijay Parihar on behalf of the senior PDF official filed objections to the execution petition.
As per the details available with Early Times, when the matter came up for hearing, Decree holder counsel Mohammad Irfan drew the attention of the court towards the previous order passes on 18th December 2019 whereby court issued the summon for the personal appearance of the chief Engineer Judgment debtor No.2, in view of non appearance the counsel of the respondent nor he himself present- Counsel for CE submitted before the court that CE moved an exemption application for today's hearing and divulged that this execution petition is of year 2008 and now they seek implementation of the same rather added that the department have initiated an exercise in this regard and take up the matter with concerned department. He stared that they (department) don't have any vacant space for shifting of transformer and poles at this moment added that as and when they get the same, they will shift it. Mohammad Irfan, counsel for decree holder rebutted the assertions of the counsel for CE that there is not any limitations for filing of decree of execution petition rather it is well settled law coupled with he submitted that chief engineer taking the court orders casually as its more than one year since date of filing of execution petition- they are not implementing the court order which shows that they have no sanctity for the court order as there involve precious lives of the decree holder along with his family at grave risk as high tension wires hanging over their house.
CJM told to decree holder counsel that counsel for CE PDD stated at bar that they have started a process in doing implementation of execution order, in case he fails to implement the same then court would take serious note of the same. After considering the submissions of the both the counsels, CJM direct the counsel for CE PDD M&RE Jammu to implement court order dated 29.11.2008 till next date of hearing which is fixed for 6th February 2020.
