Court decides 35 years old corruption case, acquits accused

JAMMU, Jan 6: Special Judge Anticorruption Kashmir RN Wattal decided 35 years old corruption case and acquitted Gh Mohammad Sofi, the then Manager DIC Srinagar, (now retired) of Lal Bazar, Srinagar, Mohammad Maqbool Hakeem, the then Industrial Promotion Officer, DIC Srinagar presently Manager DIC Budgam, Ghulam Mohammad Beigh (Prop SSI Unit M/S Best Trunk Industries HSHS Srinagar) son of Ghulam Hassan of Kanth Paristan Safa Kadal Srinagar, Bashir Ahmad Beigh (Prop SSI Unit M/S Irshad Steel Industry Batamaloo) son of Ghulam Hassan of Kanth Paristan Safa Kadal Srinagar, Mohamad Sidiq Beigh (Prop SSI Unit M/S New Rose Trunk Industry Srinagar) son of Ghulam Hassan of Kanth Paristan Safa Kadal Srinagar and Irshad Ahmad Ahanger (Prop Irshad Enterprises Chand Pora Bridge Srinagar) son of Ghulam Nabi of Chandpora Presently At Bagat Barzulla, Srinagar, who was booked by the VOJ in the year 1985.
While acquitting the accused, Court observed that prosecution has failed to prove the charge against the accused beyond any reasonable doubt and therefore, accused deserve to be acquitted by extending them the benefit of doubt. Accordingly, the charge sheet is dismissed, the accused are acquitted of the charge and their bail bonds stand discharged. The seized material if any, shall be released to the concerned after the period of appeal is over.
Before parting, Court place on record anguish regarding the inadequacy, haphazard and unfair investigation in the case and failure to fairly discharge the responsibility on part of the Investigating Officer who conducted the investigation in the case. With these observations, case is disposed of and the file shall be consigned to the records after its due completion. JNF
