Winding up of consumer courts leaves fate of many cases hanging in balance

Jammu January 8: Call it as comedy of errors or ill planning on the part of the adminstration that as the erstwhile state converted to union territory on 31st October 2019,the consumer courts including the court functioning at Janipur district court complex Jammu till the month of November 2019 is cease to exist after that the cases of consumers which are pending before this court- their fate is hanging in balance as the consumers divulged that they don't know about the fate of their cases as the administration made them non functional which brews resentment among the consumers in general and advocates in particular.
These consumer court has been made with a main motoo to address the grievances of the consumers who are being cheated,mislead etc by the private authorities so that they can knock the door of these court to get justice from these temples of justice.
Group of consumers wishing not to be named told the Early Times that the closure of consumer court left them caught between devil and deep sea and in some of the cases the stage in the cases is for final arguments and the presiding officer have to write the judgment after listening to the same, but after the transition of state into Union Territory further aggravates their problem as there is nobody at this crucial juncture who would assure them that the consumer courts will function in coming days.
"What is more intriguing and baffled is that administration first not open the consumer courts to some other alternative place before closing these including one in Jammu court complex which speaks volume of sheer apathetic attitude of the administration which otherwise talk about claims of transparency and accountability in providing proper services to the consumers- but to no avail"Consumers rued.
One of the consumer who filed a case against the toyota company is in distress and dilemma that closure of the court wrecks havoc for him as the vehicle Etious Liva model engine get non functional and for the last two years he is running from the pillar to post for getting compensation or in alternative replacement of vehicle but till date he get nothing and further said that final arguments have been done.
"Then court get closed ,my vehicle gathering dust in my porch as there is no headway after that"he maintained.
Advocates told the Early Times that for several months after period of members of the consumer court get ended then this court not hear the arguments due to which the arguments in cases get delayed and ultimately the litigants made to suffer and now winding up of the consumer courts compounded the miseries of the litigants and those advocates who deals in consumer cases they made to left for themselves added that- they have learnt administration will give the powers to the food civil supplies and consumer affairs department headed by Assistant Director, but according to them the officials of administration in FCS & CA does not possess knowledge which the Judicial officer possess.
These advocates ,turning tables on the administration for taking foolish decision without bothering about the legal rights of the consumers which are enshrined in the Jammu and Kashmir consumer protection act and played with the gullible consumers and who have been left at the mercy of God.
Consumers in general appeal to the Lieutenant Governor to comes to their rescue and direct the administration to open the consumer courts again before its too late as already they are losing patience with each passing day as the day is not far away when the consumers took to streets.
