SRINAGAR, Feb 26: In a Public Interest Litigation, A Division Bench of J&K High Court Srinagar Wing Comprising Chief Justice Gita Mittal and Justice Dhiraj Singh Thakur took serious note over not filling up the various posts under Juvnile Justice Board (JJB), directed Director ICDS to take immediate steps for completion of selection and the list of selected candidates be filed before this Court before the next date of hearing, failing which Shabnum Kamili, Mission Director, ICDS, shall remain personally present in the Court on the next date of hearing.
When the PIL Came-up for hearing, Division Bench observed that despite orders dated 21st October, 2019 and 29th November, 2019, it appears that the steps for filling up various posts to the Authorities under the Juvenile Justice Act have not been undertaken. On 21st October, 2019,. Sheikh Feroz, Deputy Advocate General informed this Court that the Mission Director, ICDS, Kashmir was responding to the information which was being sought by the J&K Services Selection Board by its communications dated 31st July, 2019 and 4th September, 2019.
It is further submitted by Feroz, Dy. AG that the delay has occurred because Shabnum Kamili, has taken over as Mission Director, ICDS, only on 5th February, 2020.
Upon this DB said that this is no excuse for completion of a process which had commenced way before 31st July, 2019 and this non-action is reprehensible inasmuch as failure to make these appointments result in rendering all institutions under the Juvenile Justice Act non-functional. The respondent Authority shall take immediate steps for completion of selection and the list of selected candidates be filed before this Court before the next date of hearing, failing which Shabnum Kamili, Mission Director, ICDS, shall remain personally present in the Court on the next date of hearing.
