Revoke SRO-202 for Justice
3/11/2020 11:03:41 PM

Omkar Dattatray

It is an irony that the popular governments make unpopular decisions which are against the interests of the people when it is the general view that the popular governments are the governments of the people. But it is now recognised that the people’s democratic governments are habitual of making the unpopular decisions and issuing anti people and anti youth orders and one such order is the most discriminately order under SRO-202 IT is not employee friendly but against the employees and needs to be revoked. The SRO-202 IS anti people, anti youth and anti-labour and anti worker and as such should be revoked for meeting the requirement of the justice .Since there is the governors rule in force in the union territory of Jammu and Kashmir and all the eyes are set on the LGs administration for the revoking of the discriminatory SRO-202 for meeting the end of justice. The SRO-202 had been issued by the people’s government which robes the youth of their genuine rights and is anti people and anti youth and hence deserves annulment for the cause of justice to an important segment of the society that is the youth. The SRO 202 in question violates the most accepted and recognised rule of equal wages for equal work and is thus violation of the constitutional provisions and is so unlawful and illegal and qualifies to be revoked without any further delay. It should be noted that this illegal SRO has been issued in the year 2015 in the month of June. Under this discriminatory SRO-202 the new recruits are being paid only the minimum basic pay for the first five years of their service and thus violate the norm of equal pay for equal work and should thus be revoked for meeting the end of justice to the youth. The SR0 202 was issued under the section 124 of the J&K constitution and while doing so the article was itself misused. Now that the constitution of J&K is not operative since 5th August of 2019, it relevant that the illegal SRO 202 should be revoked for the justice and equity.
It should be noted that the SRO202 in question had been issued by the coalition government of PDP-BJP and it denies proper and equal dues to the new recruits and hence should be scraped for the good of the people especially youth who are appointed in the erstwhile state of J&K and now in the union territory. Under this unpopular and discriminated SRO-202 the new recruits have to work on the consolidated minimum wages for a long period of first five years of their service and rightly there has been a right resentment among the new recruits and the youth of the UT and some have approached to the court as well and the youth are on the protest and now the employees unions are supporting the agitated youth It was hoped during the governors rule of Sathya Paul Mallik that the unlawful SRO 202 will be revoked but that was not the case and now the youth are agitating against the SRO 202 AND ARE PROJECTING THEIR CASE WITH the present LG of the UT and till date the discriminatory SR0 22 was not revoked for the cause of justice and the good of the people especially the youth. The SRO 202 is the violation of the directive principles of the state policy and the fundamental rights given under the erstwhile constitution of the state and hence qualifies to be revoked without any further delay. Not that the government of the erstwhile state of Jammu and Kashmir cannot make changes in the recruitment rules but those should be provide justice and should not be discriminately to the people. Since the popular government of the PDP-BJP had issued a discriminatory and unpopular as well as unjustified SRO202 it is hoped that the present LG of the state will look in to the matter and issue the order for the revoking of the unjust SRO 202 in the interest of the new recruits and the youth. The LG’s government had constituted a high powered committee to go into the matter of SRO 202 and to deliberate on the financial implications and other issues of the SRO-202 and it is hoped that the committee will go into all aspects of the matter and make recommendations for the revoking of the biased, unjust and discriminatory SRO-202 and save the careers of the youth and help the new recruits from this unlawful SRO.
