HC notice to woman officer for using ‘filthy’ language against Magistrate

SRINAGAR, Mar 14: Jammu and Kashmir High Court has taken strong note of use of ‘filthy language’ and ‘obstructing’ of a Magistrate from discharging duties at Nishat Road near Royal Golf Course on Tuesday last by a Tourism Department officer.
The court had directed its registry to issue a show cause notice, seeking an explanation as to why action in terms of applicable laws for obstructing a judicial Magistrate from performing his duties was not taken against the officer.
A division bench of Justices Ali Mohammad Magrey and Dhiraj Singh Thukur passed the directions after perusing a report of the Registrar Judicial which reveals that the Special Mobile Magistrate (Traffic) Srinagar has addressed a communique to the Registrar Judicial, stating that while he was holding the Mobile Court at Nishat Road near Royal Golf Course on March 10, one lady caused unnecessary obstruction and used a filthy language against the Magistrate. The Magistrate, therefore, has sought initiation of contempt proceedings against the lady.
“The perusal of the report of the Registrar Judicial accompanied with the communiqué of the Special Mobile Magistrate Srinagar reveals that the Magistrate has literally been manhandled and the language used against him is deplorable,” the court said. However, before proceeding further, the court directed the Magistrate to file his own affidavit as also of the staff who were accompanying him on the date of occurrence detailing out the events.
“Registry shall issue a notice at the official address of the lady named in the report of the Magistrate after ascertaining her particulars from the Commissioner Secretary, Tourism Department. Jammu, asking her to show cause as to why she shall not be proceeded against in terms of applicable laws for obstructing a judicial Magistrate from performing his duties,” the court said and posted the matter on March 20.
