SRINAGAR, Jan 1: The 4th Additional District Judge Srinagar has directed the Jammu & Kashmir Football Association (JKFA) not to take any policy decision for the time being and take appropriate steps for the conduct of elections at the earliest.
The 4th Additional District Judge Srinagar Haq Nawaz Zargar has asked the office bearers of JKFA to restrain from taking any policy decision. The judge while hearing the petition also asked the JKFA office bearers to hold the elections at the earliest in order to remove the misgivings.
“In the meantime, till objections are filed and same are considered and till next date of hearing, non-applicants/defendants are directed not to take any policy decision regarding the association and are further directed to take appropriate steps for conduct of elections for the association,” the judge ordered.
The judge however ruled that the order is subject to objections of other side and the other side is at liberty to seek vacation or modification of this order.
The judge directed the plaintiffs/applicants to comply with the procedure prescribed under proviso to rule 3 of order 39 CPC. It has also been mentioned that the notice to other side has been issued and the case is listed for January 31, 2021 for the next hearing.
In the order it has been written that copy of the order has been forwarded to defendant number 5 Secretary All India Football Federation (AIFF) located at sector 19 Phase I Dwarka New Delhi through the registered post for compliance.
The AIFF is one of the defendants along with Secretary JKFA Prof Bashir Ahmad Shah, Zameer Thakur, ‘Self Proclaimed’ President JKFA, S A Hameed, Executive Chief JKFA and Surinder Singh Bunty, Treasurer JKFA.
In the petition it has been said that office bearers of JKFA have been in office since 2004 continuously without conducting the elections according to the provisions of the Constitution of JKFA. It has also been prayed that since JKFA is a permanent member of AIFF and the Association is obligated to comply with the rules and provision of Constitution of AIFF.
The petition said that the President, Vice President, Treasurer and the members of executive committee shall be elected to general body for a period of four years, however, the President and Treasurer shall cease to hold the post on attaining the age of 70 years.
It has prayed that elections for the Association are conducted without any further delay and till then the Association is restrained from taking policy decisions.
