Court rejects bail of cop, other person involved in selling of heroin

JAMMU, Oct 20: Additional Sessions Judge Kathua Kamlesh Pandit rejected the bail application of Manzoor Ahmed, police cop working in District Court Kathua and Ram Saroop in NDPS case.
The police report said that on 9-9-2021 personnel of police station Hira Nagar headed by PSI Vikram Singh Manhas were performing naka duty and on the way back to Police Station at about 1450 hrs when reached at Bandhi Nala near Pulli, one person on seeing the police vehicle tried to hide himself in nearby bushes who was later on caught.
The accused disclosed his name as Ram Saroop S/o Late Faquir Chand R/o Kannah, Kootah. During course of search and personal checking police recovered 40 grams of heroin from his possession. On this, case under FIR No.118/2021 was registered against the accused u/s 8/21/22 under NDPS Act and investigation was taken up by Inspector Anil Sharma, SHO Hira Nagar. On the course of questioning the arrested accused Ram Saroop disclosed that he has bought this 40 grams contraband heroin from Manzoor Ahmed who works at District Court Kathua.
Additional Sessions Judge Kathua observed that one of the accused person bought the seized contraband from the other accused person who happens to be the employee of the disciplined belt force and incidentally posted in Malkhana where all the contraband is deposited for trial of the cases.
The court observed that drug traffickers like accused person are spreading the addiction of Narcotics & Psychotropic substances among the youth section of society making them slaves of the same who when become addicts not only spoil their lives but also ruin the lives of their family members, therefore, the release of the accused persons/applicants herein at this stage will not meet the ends of justice.
Consequently in the facts and circumstances of the instant case, the apprehension of the prosecution appears to be reasonable that once the accused persons are admitted to bail, they will not debar themselves from tampering with prosecution evidence or repeating the offence, moreover, it would have adverse affect on the society at large. Therefore, while considering all what has been discussed herein above and without going into the merits of the case, the accused persons/applicants herein have failed to convince this court for their admission on bail. Consequently bail plea of accused/applicants is out rightly rejected.
