Chowadi murder case: Court sentences 5 to life imprisonment

JAMMU, Feb 22: In a much publicized chowadi murder case, on Tuesday 2nd Additional Sessions Judge Jammu awarded life-imprisonment to five accused in the case.
2nd Additional Sessions Judge Jammu Rajinder Sapru after hearing APP DP Singh for the UT awarded life-imprisonment to Bashir Ahmad, Abdul Majeed, Javed Ahmad, Mohammad Shafi and Rashid Mohammad for murdering one Shams-ud-din.
The prosecution case as set up in the police report U/S 173(2) Cr.P.C are that on 24.08.2009 a written complaint came to be submitted by complainant Naseer Ahmad (PW-1) at the Police Station Channi Himmat, stating that he is the resident of village Chowadi, Jammu and accused persons, namely 1. Bashir Ahmed son of Qutab Din (A-1) 2. Abdul Majeed alias Bhola (A-2) 3. Javed Ahmed (A-3) and 4. Parvez Ahmed sons of Bashir Ahmed (A-4)caste Gujjar are also residents of village Chowadhi who have constructed a house adjacent to his house and are having a land dispute with him and his father. At about 8.40 a.m that day the above named accused persons came to their own house in a Maruti 800 car and from there they started abusing him and his father. He, his father and other members of family, at that time, were standing in the courtyard of their own house. After some time accused persons namely Bashir Ahmed son of Qutab Din, Abdul Majeed alias Bhola, Javed Ahmed, Mohammad Parvez, all sons of Bashir Ahmed, Mohammad Shafi son of Hussain Mohammad carrying loaded guns and accused Abdul Rashid son of Chirag Din carrying an Axe (Kulhari), entered their house with the criminal intention to kill them and there they started firing in the air. Out of fear, he (complainant), his father and other family members went inside their house and bolted the door from inside. Accused Abdul Rashid, banged the door with the axe (Kulhari) in his hand and other accused persons also tried to push open the door. Accused persons thereafter, came inside their house where accused Bashir Ahmed opened fire from the gun in his hand which hit his father in his head and thereafter, accused Abdul Majeed opened another fire with the gun carried by him which hit his father in his abdomen. Fire opened by accused Javed Ahmed with the gun carried by him hit his brother-in-law, namely, Arshad Ali and the fire opened by accused Mohammad Shafi from his gun, hit a labourer; that accused Abdul Rashid attacked them with an Axe. On a hue and cry being raised all the six accused persons fled from the spot along with the weapons being carried by them. On receipt of this information at the Police Station, concerned a case under FIR No. 79 of 2009 was registered for the commission of offences, punishable U/Ss 307, 452, 147, 323 of the RPC and Section 3/25 Arms Act and the investigation was started which was entrusted to Inspector Bishnesh Kumar Bhagat the then SHO P/S Channi Himmat, Jammu who on reaching the spot had come to know that firing had taken place there and the injured persons had already been shifted to GMC Hospital, Jammu. He, as such, had proceeded to hospital where he had come to know that injured Shamas Din had succumbed to the injuries sustained by him and that Injured Arshad Ali had been admitted in GMC hospital, Jammu for his treatment and the injured labourer had been admitted to Govt. Gandhi Nagar, Jammu for his treatment. After the confirmation of the death of Shamas Din, offence under section 302 RPC came to be added.Court further ordered that all the Sentences awarded to the accused persons shall run concurrently.
