JAMMU, Apr 5: A Public Interest Litigation (PIL) has been filed by Jammu and Kashmir Sharnarthi Action Committee, seeking direction to the respondents to allow the DPs of 1947 to submit mandatory documents as are being submitted by DPs of 1965 and 1971 for the purposes of availing the benefit under central assistance scheme for one-time settlement of displaced families from POK and Chhamb under prime minister's development package-2015 and also seeking quashing of notice dated 9-2-2022 which has been issued by respondent 2 wherein and where under the scheme has been proposed to be closed after 5-3-2022.
A Division Bench of Jammu & Kashmir High Court comprising Chief Justice Pankaj Mithal and Justice Moksha Khajuria Kazmi observed that the petitioner is holding brief on behalf of displaced persons of the year 1947. It is contended that some financial scheme for one-time settlement of displaced persons under the Prime Minister's Development Package 2015 was introduced.
The scheme mentions the documents to be submitted by displaced persons of 1965 and 1971 which inter alia includes the ration card and revenue extracts and the grievance of the petitioner is that unfortunately while extending the similar benefits to the displaced persons of 1947, the documents which have been provided to be submitted does not include ration card and revenue extracts as has been included in the list of documents to be submitted by the displaced persons in the year 1965 and 1971, issues notice to Union of India through Home Secretary Ministry of Home Affairs and Union Territory of J&K through Department of Disaster Management, Relief, Rehabilitation &Reconstruction.
ASGI Vishal Sharma accepted notice on behalf of respondent 1 and prayed for three weeks' time to file a counter affidavit. The DB directed Deputy AG Vishal Bharti may also seek instructions and, if necessary, may file a formal affidavit.
