JAMMU, Aug 26: The Jammu and Kashmir and Ladakh High Court has directed the PWD Commissioner Secretary and the Divisional Commissioner, Kashmir to file personal affidavits to indicate the progress made in the completion of Circular Road Project from Dalgate to Hazratbal in Srinagar.
In a Public Interest Litigation regarding widening and completion the division bench of Jammu & Kashmir and Ladakh High Court comprising Chief Justice Pankaj Mithal and Justice Wasim Sadiq Nargal while taking into consideration the status report filed by the Chief Engineer PWD (R&B) Department, Kashmir observed that though substantial steps have been taken for widening of the road from Dalgate to Zakura, Srinagar, but certain impediments are there, such as difficulty in the acquisition regarding certain structures.
When the PIL came-up for hearing, the DB observed that it appears from the order sheet that previously the development work could not be completed on account of pendency of two cases Iram Shehri and Others versus Waheeda Akhter and Others and another titled Mushtaq Ahmad Kachroo and Others vs. State of JK & Others, and accordingly, directions were issued to the Principal District Judge to get the aforesaid suits decided expeditiously, but, we are informed that till date the suits have not been proceeded ahead and continues to remain pending.
The DB directed Collector Land Acquisition to take prompt steps to ensure completion of the project. The DB also directed Finance Department to examine the difficulties being faced in the acquisition process for want of adequate funds.
The DB further directed Principal District Judge, Srinagar to submit his explanation why the above two cases have not yet been decided despite specific direction of this court vide order dated 23.12.2019 to ensure that the said cases are positively decided within a period of one year. —JNF
