Man awarded one year imprisonment in attack case

JAMMU, May 4: Judicial Magistrate Chenani Rekha Sharma awarded one year imprisonment to Ajay Kumar in the attack case.
The brief facts of the case as per the chargesheet and as relied by the prosecution are that on 22-01-2015 complainant's son was on his way to purchase necessary articles for his home and when he reached Sudhmahadev at 01:30 he saw accused Ajay Sharma S/o Bishan Dass R/o BachhalTehsil Chenani Distt. Jammu who had restrained his son namely Arun Gupta who had gone to market earlier and was beating him with fists and blows. On seeing this when the complainant ran to save his son from the clutches of said. accused, the accused fled away from the spot. Thereafter some persons reached the spot and took the son of complainant, who was lying injured on the spot to the Sudhmahadev hospital in a private vehicle. Later he was shifted to Chenani hospital and from there he was referred to District Hospital Udhampur and was discharged on 29-01-2015. On receipt of the information FIR no. 04/2015 was registered and after investigation offences under Section 341, 323, 325 RPC were found to be proved against the accused. Hence the challan against the above mentioned accused person was produced.
Judicial Magistrate Chenani Rekha after hearing APP Sahlini Gupta for the police, sentenced the accused person namely, Ajay Kumar S/o Bishan Das R/o Bachal Tehsil Chenani Distt. Udhampur to undergo Simple Imprisonment of six months u/s 323 RPC and pay a fine of Rs. 1000/- only u/s 323 and in default of fine to further suffer Simple Imprisonment of 15 days; and I also sentence the accused person to undergo Simple Imprisonment of 01year u/s 325 RPC and pay a fine of Rs. 2000/- only and in default of fine to further suffer Simple Imprisonment of one month. Both the sentences shall run concurrently. The convict present in the Court be taken into custody and shall be lodged in District Jail Udhampur to serve the imprisonment.
