Minor’s rape case: Court awards 10 years Rigorous Imprisonment, Rs 25000 fine

Jammu, May 31: The 2nd Additional Sessions Judge of Srinagar, Renu Dogra, delivered a verdict today, sentencing Irshad Ahmad Malik, son of Habib-ullah Malik from Ahlan Gadwak Kokernag, Anantnag (currently residing in Anchar Soura), to 10 years of rigorous imprisonment and imposing a fine of 25,000 rupees for the rape of a minor.
The prosecution's case, as presented in the charge-sheet, states that on May 18, 2012, the complainant filed a written report with the Soura Police Station, stating that he worked as a laborer and would leave his home early in the morning for work, returning in the evening.
He lived with his daughter (identity withheld) and his wife. In his neighborhood, Irshad Ahmad Malik, son of Habibi-ul!ah Malik, resided as a tenant in the house of Ghulam Qadir Wani, son of Sh Mohammed Wani, from Sheiklh Mohallah Soura. The complainant's minor daughter used to visit Irshad Ahmad's residence.
A few days earlier, the complainant's daughter complained of abdominal pain, so he took her to the doctor for treatment. During the examination, important tests were conducted, confirming that the victim was pregnant. Upon inquiry, the victim disclosed that Irshad Ahmad, a resident of Rajouri, had raped her multiple times.
Upon receiving the report, the police registered a case under FIR No 33/2012, charging Irshad Ahmad Malik with the offense punishable under Section 376 RPC (Ranbir Penal Code) at Soura Police Station.
After hearing arguments from both sides, the 2nd Additional Sessions Judge, Renu Dogra, opined that considering the circumstances, including the fact that the offense was committed against a minor girl, a sentence of 10 years of rigorous imprisonment with a fine is an appropriate punishment in this case.
Accordingly, the court sentenced Irshad Ahmad Malik to 10 years of rigorous imprisonment and a fine of 25,000 rupees for the offense under Section 376 RPC. In case of default in payment of the fine, the accused will serve an additional 6 months of simple imprisonment.
The convict, who was present in the court, will be immediately taken into custody and lodged in the Central Jail Srinagar to serve the imposed sentence.
