Court asks ACB Director to further investigate in transfer industry case

Jammu, July 8: The Additional Sessions Judge Anticorruption Doda, Amarjeet Singh Langeh, has returned the closure report of the transfer industry case and directed the Director of Anti-Corruption Bureau (ACB) to conduct further investigation.
The case originated from a complaint filed by the then Director of School Education Jammu, Ravinder Singh, alleging malpractices in transfers by the then in-charge Chief Education Officer (CEO) of Kishtwar, Ajit Kumar Sharma. The complaint highlighted transfers made for pecuniary benefits in connivance with subordinates. Following the complaint, an FIR was registered, and the investigation revealed various irregularities, including transfers of employees without proper justification and in violation of rules and regulations.
During the investigation, it was found that Ajit Kumar Sharma, during his tenure as in-charge CEO of Kishtwar, had transferred or attached 135 employees, including teachers and non-teaching staff. Some transfers were made without the competence to do so, and some individuals were transferred multiple times within a short period. The investigation also uncovered suspicions of involvement by other individuals in the transfer scam.
The investigating officer concluded that allegations of malpractices and corrupt practices could not be established against the accused, and the case was closed as "not proved." However, the Additional Sessions Judge observed glaring acts of omission and commission by the investigating officer, pointing out the irregularities and the failure to record statements from key witnesses and pursue further inquiry.
The court directed the Director of ACB to conduct a comprehensive investigation, considering the findings of the inquiry report and the need to address the suspicious activities and protect the interests of justice.
