Court rejects bail of 4 LeT terrorists
7/19/2023 10:43:26 PM

Early Times Report

Jammu, July 19: Additional Sessions Judge Doda Amarjeet Singh Langeh rejected the bail applications of four LeT terrorists namely Showket Ali, Akhter Hussain, Abdul Rashid alias Abdullah and Shafkat Hussain who attacked on Police post and killed one SPO.
According to the police case that An information was allegedly received by Police Post Kahara on 08.05.2017 at 2.50 a.m. from the reliable sources to the effect that some unknown militants/terrorists laced with illegal arms and ammunition - attacked police picket, Tanta and targeted SPO Kiker Singh and SPO Mohammad Yunis with indiscriminate firing, as a consequence of which both were seriously injured and were lying in pool of blood in the aforesaid post.
Perpetrators, it was alleged – subsequently fled from the spot taking advantage of darkness. Finally, on this information FIR NO. 35 of 2017 for offences under sections 302 and 120-B of RPC and Section 7/27 of Arms Act was registered and investigation began. Subsequently, on 09.05.17, injured SPO Mohammad Yunis succumbed to injuries in the hospital. Special investigating team was constituted under the command of Additional SP Bhaderwah to investigate the case.
Additional Sessions Judge Doda Amarjeet Singh after hearing both the sides while rejecting the bail applications observed that targeting a police picket with a perplexingly meticulous plan in an obviously atrocious manner resulting in serious gun –shot injury to one SPO and death of another- is prima facie a grave and heinous act attracting interalia, offence of murder under penal code which carries punishment of death sentence also. The evidence led by prosecution as aforesaid, does also lead prima facie credence to prosecution case. That apart, given the influence and kinetic means that petitioners have as is inferable from the manner they allegedly perpetuated occurrence in question – is yet another circumstance which dissuades the court to grant relief as prayed in the application.
