Fake gun license scam: CBI Court frames charges against former DC, others

Jammu, Dec 11: Special Judge CBI SC Katal framed charges against Farooq Ahmad Khan the than DM Kulgam (now retired), Syed Farooq Ahmad the than Stenographer/Judicial Clerk in office of DM Kulgam (Now retired), Mohammed Imran Lohri Owner of M/S Imran Gun House Arms and Ammunition Dealer behind Madrasa Wannoh post Anantnag & Mohammad Siddiq Proprietor M/S Kotwal Gun House Arms & Ammunition dealer Kotwal Mohalla Anantnag in much publicized fake gun license scam.
The brief facts of the case are that during the period from 2012 to 2016 the District Magistrate of various Districts of J&K including District Kulgam have fraudulently and illegally issued gun licences which run in thousands. The charge sheet in hand pertains to the gun licences issued by District Magistrate Kulgam who in connivance with Co-accused have fraudulently and illegally issued the gun licences. The licences authority have brazenly flouted the norms, procedures and rules governing the subject in lieu of monetary considerations by abuse of their official position as public servant which discloses the commission of above mentioned offences.
The final report further reveals that Farooq Ahmad Khan (A-1) the then DM Kulgam (now retired) during his tenure from 01.01.2012 to 18.05.2012 as DM Kulgam in pursuance to the criminal conspiracy hatched with co-accused named above issued multiple Arms licence to different persons not resident of Kulgam without proper police verification. Arms licences have been issued illegally by him in connivance with accused No. 2 P.A/Judicial Clerk and gun house dealers in lieu of monetary considerations.
The accused in this case are, accused No. 1 namely Farooq Ahmad Khan the than DM Kulgam (now retired), the accused No. 2 namely Syed Farooq Ahmad the than Stenographer/Judicial Clerk in office of DM Kulgam (Now retired), Accused No. 3 namely Mohammed Imran Lohri Owner of M/S Imran Gun House Arms and Ammunition Dealer behind Madrasa Wannoh post Anantnag & Accused No. 4 namely Mohammad Siddiq Proprietor M/S Kotwal Gun House Arms & Ammunition dealer Kotwal Mohalla Anantnag.
To bring out criminality on part of accused persons, the I.O has cited four instances regarding issuance of illegal Arms licences. These licences have been fraudulently & illegally issued in favour of ineligible persons who are neither resident of nor posted within the jurisdiction of District Magistrate Kulgam. In one case gun licence was issued in favour of Nazir Ahmad Khan R/O Anantnag, who had initially approach the DC Office Anantnag for gun licence but he was refused the licence by the concerned District Magistrate for the reason that gun licences are not issued due to law and order situation in Anantnag District. Thereafter, he came in contact with Mohammad Shafiq Proprietor M/s Kotwal Gun House, who demanded Rupees Twenty thousand for the Arms licences including cost of a single barrel gun. As per the investigation the arms licence bearing No. DMK/Arms/12/140 dated 14.05.2012 was issued by accused No.1 in favour of Nazir Ahmad, the said licence was issued with area validity extended to the whole J&K State despite, no verification of character and antecedents as well as threat perception was got checked. The application for gun licence is in the handwriting of accused No. 4 and it bear signature of accused No.1 as issuing authority. The said licence has been issued by paying money to the accused persons through accused No. 4. Moreover, two different arms licence numbers are mentioned on the arms licences booklet of Nazir Ahmad ie DMK/183/2012 and DMK/Arms/12140 both dated 14.05.2012 which reveals the illegality in issuing the arms licences. Similarly, in case of Adil Nazir Bhat R/O Shangus District Anantnag, Mohammad Hanief Khan R/O Shangus District Anantnag & Qaliya Khan working at ATM Guard YES Bank Anantnag (not resident of Kulgam), the Arms licence have been issued in their favour in lieu of monetary consideration for Rupees Twelve Thousand received through accused No. 3, Rupees twenty thousand & Rupees Eighteen thousand received through accused No. 4.
Special Judge CBI SC Katal after hearing both the sides observed that So far as the conspiracy hatched by the accused persons is concerned. The facts and circumstances of the case and evidence assembled by the investigation officer shows that the accused persons have illegally issued gun licences in lieu of obtaining monetary gains. The accused persons played different role to achieve their common goal of making money by illegal means.
Court further observed that keeping in view the above discussion, this court is of the considered view, that the above referred material evidence is sufficient to raise the grave suspicion as regards to the alleged involvement of accused persons in commission of alleged crime ie abuse of official position by accused No. 1 & 2 in pursuance to criminal conspiracy hatched with co-accused no 3 to 4, whereby the accused have fraudulently and illegally issued the Arms licence in favour of many persons who were neither residing nor posted in District Kulgam at relevant time. Moreover, the Arms licences have been issued without verification of character and antecedents for monetary considerations.Hence, prima facie case is made out for framing the charge against the accused persons. The accused persons are charge-sheeted for commission of offences U/Sec. 120-B, 420 RPC r/w Section 5(1)(d)/5(2) J&K PC Act. Svt.2006. The accused persons are charge-sheeted accordingly. Charge is read over & explained to the accused persons. (JNF)
