Jammu, Oct 9: Special Judge NIA Jammu Madan Lal cancelled the bail of Ex-Minister Jatinder Singh @ Babu Singh in terror funding case for violating the conditions set by the court.
This order has been passed by the Court in an application filed by SSP SIA seeking cancellation of bail of accused Jatinder Singh @ Babu Singh on the grounds that vide order dated 7.06.2024, the non-applicant was granted temporary bail by this Court, subject to various conditions which inter-alia included conditions: that he shall not change his residence during the period of temporary bail; not go beyond the limits of District: Kathua and that he shall wear GPS Tracking devices to be provided by the SSP SIA Jammu and adhere to all the conditions imperative for ins effective use.
The interim bail granted to the accused vide order dated 07- 06-2024 was made absolute on 25-06-2024 subject to the conditions already imposed on him vide the order dated 07-06-2024. On 10-08-2024, a report has been furnished by the GPS Monitoring Unit that the accused/non-applicant, who was fitted with GPS Tracker on his leg as per the direction of Hon’ble Court has crossed GEO FENCE and moved towards Chandigarh without informing the Monitoring Unit regarding the permission obtained from the Trial Court for crossing J&K and has further given the details of latitude, longitude, which depicts that at about 9.49 hrs the applicant has reached Pathankot after crossing Lakhanpur,Toll Plaza at 05.35hrs. The accused/non-applicant after crossing the Kathua has moved towards Hoshiarpur through Pathankot and was at Rupnagar Punjab with Lat./Long. (31.949772,76.531120) at 11.09 hrs. The report submitted by GPS Monitoring Unit is annexed herewith. 4. That the movement of non-applicant/accused beyond the limits of District Kathua is without any permission of the Ld. Trial Court and the same constitutes violation of the conditions It is surprising that the non- imposed by the Ld. Trial Court, while granting bail. applicant/accused has intimated SSP SIA Jammu through e-mail regarding his pre-planned visits to Punjab, without seeking any permission from the Ld. Court. The e-mail sent in thisregard is annexed. Therefore, it is prayed that the concession of bail granted to the accused/applicant may very kindly be withdrawn for the violation of the bail conditions.
Special Judge NIA Madan Lal after hearing both the sides, allowed the interim bail granted to the non-applicant, namely Jatinder Singh, vide order dated 07-06-2024 and made absolute on 25-06-2024 is hereby cancelled and non- applicant present in the Court is ordered to be taken into custody and send to District Jail: Jammu. Office shall prepare docket for his lodgment in the jail with direction to the Superintendent District Jail: Jammu to produce the said accused before this Court through virtual mode on each and every date of hearing.
