Court acquits accused in Rape, other charges

JAMMU, May 21: Fast Track Court, Jammu acquitted accused Om Parkash in rape and other charges. Allegations against accused were that on 25.05.2019 he went to house of prosecutrix in absence of her family members and raped her and accused was spotted while leaving the house by father of prosecutrix. Subsequently an FIR for offences under sections 452/376 of RPC was registered and investigation started.
Presiding Officer Fast Track Court Amarjeet Singh Langeh, while dismissing the Challan held that " If prosecutrix earlier also had coitus with accused and if she chose to keep it a secret, then only inference which could be drawn in such circumstance is that she was a willing partner of alleged sexual assault," adding "sudden arrival of father of prosecutrix at his residence while she was putting on clothes, it appears, not only put prosecutrix in an awkward position but also made her to respond her father in panic that accused raped her when her father asked her reason for uneasiness".
"Interestingly also, prosecution has not been able to show even vaguely as to whether accused was a routine "par for the course" visitor to prosecutrix or he visited her on the day of occurrence alone", Court further observed. Notably, medical evidence also conflicted with prosecution version and FSL report was also negative in the case.
Against this backdrop, prosecution therefore cannot count and capitalize on sole testimony of prosecutrix which is fragile, vulnerable and kind of ivory tower narrative inspiring not even a shred of confidence at all, further held the court and dismissed the challan. —JNF
