Court rejects bail of woman involved in terror activities

Jammu, July 7: 3rd Additional Sessions Judge Jammu Madan Lal rejected the bail application of one Shabnam Akhter who was allegedly involved in terrorism related activities. As per police case during the course of investigation, it was found that PAK handler Mohd. Qasim @ Salman R/O Angralla tehsil Mahore who had joined militancy in the year 2002 and worked with brother of accused Zaffer Iqbal namely Mohd. Ishaq who was later killed by security forces in an encounter at Kalakote, Rajouri on 25.09.2002 and later on accused Mohd. Qasim exfiltrated to POK/Pakistqan. Constantly, he is trying hard to revive militancy in the area by radicalizing local youths specially relatives of killed militants through various social media apps and VOIP calls. In this regard, seven cases have been registered against the accused Mohd. Qasim @ Salman in different Police Stations of different Districts including Reasi. The accused Mohd. Qasim approached accused Zaffer Iqbal through social media Apps to revive militancy in the area by offering monetary benefits to carry out task given by Mohd. Qasim. On the direction of PAK handler Mohd. Qasim, accused Zaffer Iqbal received first consignment containing rupees thirty thousand and one hand grenade from Kalakote forest area of Rajouri district and second consignment containing rupees three lakh, two Glock pistols, four Glock pistol magazine and (22) twenty two 9 mm rounds from Chingus forest area and after receiving the said consignment he had dumped arms, ammunition and explosive at Bhall Angralla in a hideout at forest area and handed over rupees one lakh eighty one thousand to co-accused namely Shabnam Akhter which was recovered on her disclosure who is the wife of accused Zaffer Iqbal and the accused Zaffer Iqbal had deposited rupees one lakh in the account No. 0612040800000182 of co-accused Shabnam Akhter and was accordingly converted into FDR and remaining forty nine thousand was deposited in his own bank account bearing A/C No. 0612040210601069 at J&K Bank Branch Bagga Mahore on dated 16.08.2022, despite the fact that co-accused Shabnam Akhter was aware of the fact that the said money was received by accused Zaffer Iqbal from the PAK handler Mohd. Qasim for carrying out terrorist activities in and around Mahore area and co accused Shabnam Akhter despite knowing everything had helped accused Zaffer Iqbal in waging war and disturbing peace and tranquillity of the UT of J&K.
3rd Additional Sessions Judge Jammu Madan Lal after hearing APP Manmohit Sharma for the UT, observed that as per the evidence the allegations of offences under Sections 13, 38 & 40 of UA (P) Act to which the bar of Section 43 (D) (5) UA (P) Act is applicable, appears to be true at this stage of the evidence. Therefore, the applicant has failed to substantiate the grounds of bail considering the evidence and time being taken by Prosecution to produce witnesses, the statements of recorded witnesses and yet to be recorded & the rigor of Section 43-D(5) of UA (P) Act, the application of the applicant is pre-mature and without merits. The applicant has failed to make out a case for grant of bail, at this stage, so the application cannot be allowed and bail cannot be granted. Application is rejected and bail is denied. (JNF)
