DB extends stay on ban of Construction, sale of Khad | PIL regarding illegal constructions in Khad | | Early Times Report Jammu, Aug 14: In a Public Interest Litigation filed by Balbir Singh present Secretary of a registered Society called Kailash Assisto Oceanic Society (an NGO) against inaction on the part of the State in implementing the Jammu and Kashmir Water Resources (Regulation and Management) Act, 2010, a Division Bench of State High Court Comprising Justice Virender Singh and Justice Tashi Rabstan after hearing Adv BR Manhas appearing for the PIL observed that notices issued to respondents have not been received back and directed Registry to list this PIL in the next regular cause list and till than earlier interim direction in which Division Bench has stayed Construction in the areas of water body or abetting the water body and also stayed the sale of land concerning the bed of the river and the land recorded in the revenue records as KHAD, to continue till further orders. In the meanwhile an application was filed by one Rattan Parkash praying for impleadment as an intervner in the instant PIL in which Advocate Aseem Sawhney has submitted that the petitioner is 80 years of age and in 1980's had purchased about 20 -22 kanals of land at Village Chowadi- Sunjuwan, Jammu falling in Khasra no. 22 which is recorded as Gair Mumkin Khad in the revenue records and therefore and had preserved/ kept these lands for last days of his life when he could require for his treatments for ailments or dispose of or transfer the same to family and heirs. In the application Advocate Aseem Sawhney appearing for the applicant submitted that petitioner in the PIL has concealed the facts from the Court and filed a false affidavit about his antecedents, where he has calimed to be a social worker, whileas the petitioner is a political leader and belongs to PDP (People's Democratic Party) and is a State Executive Member of the PDP. Upon this Division Bench directed Registry to tag this application with PIL and list in the next regular cause-list. —JNF |
