NDPS case discharged as 'seizure' doesn't fall under of NDPS category

Jammu, Feb 14 (JNF): Principal Sessions Judge Jammu RS Jain today discharged the case of one Shakil Ahmed at time of framing charge, who was booked by the police under NDPS Act, as Public Prosecutor failed to show any provision of the Act/ Rules which would show that the seized substances is covered by the provisions of NDPS Act.
While discharging the accused from the NDPS Act, Principal Sessions Judge Jammu observed that prosecution is at liberty to prosecute the accused under Drugs and Cosmetic Act or any other law for the time being in force.
According to the police case against the accused is that on December 2, 2014 at Mausaffir Khana Railway Station Jammu, the police party searched belongings of accused and recovered 70 bottles of corex which is a cough syrup and after completion of the investigation challan was presented.
