Jammu, Mar 20 : The high court today stayed the premature transfer of Tushar Kanti Sharma who was recently transferred by the state cabinet from J&K Special Tribunal as Secretary, Government ARI and Trainings Department. The court directive came in a petition filed by Tushar , challenging his premature transfer. Staying his transfer, Justice Janak Raj Kotwal observed that the petitioner assailed his transfer from the post of Member J&K Special Tribunal to the post of Secretary, Government ARI and Trainings Department, mainly on the ground that the transfer being premature is in violation of the transfer policy formulated by the government as per its order No 861-GAD of 2010 and that is at the verge of retirement, left with six months of service hereafter. Justice Kotwal observed that it is averred in the petition that in the span of less than 1 year, petitioner has faced four transfers in as much as petitioner has been posted in his present place only on July 16, 2014, issued notice to Chief Secretary J&K and others and ordered that till next date before the bench the impugned transfer of petitioner shall remained stayed. |
