Court accepts protest petition, orders investigation by DSP into cheating case | | | Early Times Report
Jammu, Aug 23: Special Mobile Magistrate, Udhampur, has ordered further investigation into the challan titled "State v/s Prem Nath and others" for offences in a cheating case. The complainant namely Rameshwar Sharma through his counsel had on August 19 last filed a complaint in the court of CJM, Udhampur, against Prem Nath and his daughter Nishu Rani under sections 420, 467, 468, 471, 403, 198 and 34 of RPC. The CJM's court forwarded the complaint under section 156(3) of CrPC to Udhampur police station for investigating the matter under law. The concerned investigation agency, after investigating into the case, produced the challan under sections 420, 403 and 34 of RPC only and removed the sections 467, 468, 471 and 198 of RPC. Feeling aggrieved of per functionary investigation by the concerned investigating agency, the complainant filed a protest petition against the challan so produced before the court and prayed for conducting further investigation into the challan from independent some investigation agency or crime branch. The court, after hearing both the sides and appreciating the material and evidence on record, was convinced by the arguments put forth by the counsel of the complainant and directed the SSP Udhampur to get the further investigation conducted by an officer not below the rank of a DSP. The complaint in his protest petition has also prayed for initiating appropriate action against the investigating agency for conducting per functionary investigation thereby shielding the other culprits who may be involved in the commission of crime and the court has kept the consideration of prayer reserved to this effect which shall be considered at a later stage after the further investigation is conducted into the matter. |
