HC stays transfer of I/C Principal

JAMMU, Jan 14: Vacation Judge of J&K High Court Jammu Wing Sanjay Gupta stayed the transfer of Asha Saraf Kakroo who was transferred from Incharge Principal Gover-nment Camp Higher Secondary School, Nagrota Jammu to I/C HOD DIET Banihal.
Justice Sanjay Gupta after hearing Adv Veenu Gupta at length observed that the transfer order was clear violation of SRO 307 dated 11.07.2018. As per this SRO every transfer proposal shall be processed in accordance with the provisions of the Jammu and Kashmir Government Business Rules and Transfer Policy notified vide Government Order No.861-GAD of 2010 dated 28.07.2010 and as per order dated 28.07.2010, the minimum tenure of a Government employee on a post shall be two years and maximum of three years. Admittedly, in the present case, the petitioner has been transferred before two years.
Justice sanjay Gupta iusue notice to the respondents, returnable within four weeks and in the meanwhile ordered that subject to objections from other side and till next date of hearing before the Bench, impugned order No.03-Edu of 2019 dated 01.01.2019 so far it pertains to the petitioner, shall remain stayed.
