3 years imprisonment to Veterinary Health Officer, his driver in trap case

Jammu, Mar 1: Additional Sessions Judge Anticorruption Jammu Tasleem Arief today awarded 3 years imprisonment to M.L Gupta Veterinary Health Officer and his driver Jaswant Lal who were caught red-handed by the VOJ while accepting bribe money.
One Riyaz Ahmed Bhat lodged a verbal report at P/S Vigilance Organization Jammu alleging therein that M.L Gupta Veterinary Health Officer of JMC Jammu came to his shop and lifted the meat saying that he was not paying Rs. 2000/- per month as bribe. As per complaint, the officer remained adamant on demand of bribe of Rs. 2000/- and he came to Vigilance Organization for taking necessary action. Consequently, case FIR No. 18/2011 u/s 5 (2) J&K PC Act r/w 161 RPC was registered in P/s Vigilance Organization Jammu against M.L Gupta Municipal Veterinary Officer JMC, Jammu and he was caught red handed while demanding and accepting an amount of Rs. 2000/- as bribe from the complainant. As the accused after accepting the bribe money had handed over the same to his conduit Jaswant Lal, both the accused were formally arrested.
Court after hearing both the sides observed that Manohar LaL Gupta son of Prem Nath Gupta, the then Municipal veterinary officer Jammu resident of Salore Tehsil Billawer District Kathua, present resident of Suraksha Vihar Top Paloura District Jammu shall undergo simple imprisonment for a term of two years and to pay fine of a sum of fifteen thousand rupees upon his conviction for the commission of offence under section 5 (1) (d) punishable under Section 5 (2) of J&K Prevention of Corruption Act. The convict shall, in default of payment of fine, undergo simple imprisonment for a term of one month.
Court further observed that Jaswant Lai son of Jagdish Raj (driver), resident of Sector 4 Nanak Nagar District Jammu in case shall undergo simple imprisonment for a term of two years and to pay fine of a sum of fifteen thousand rupees upon his conviction for abetment of the offence of criminal misconduct under section 5 (1) (d) punishable under Section 5 (2) of J&K Prevention of Corruption Act; the convict shall, in default of payment of fine, undergo further simple imprisonment for a term of three months.
