GAD revokes pre-mature retirement order of KAS officer | | | Saahil Suhail Early Times Report SRINAGAR, Mar 1: The General Administrative Department (GAD) has finally revoked the pre-mature retirement order of a KAS officer. In 2015, 63 civil servants including KAS officer Mohd Yousuf Bhat were retired prematurely by PDP-BJP government. The officers were termed as 'deadwood' in the administration and removed. However, the aggrieved civil servants went to court against the premature retirement and fought vigorously. In 2016, the Single Bench of Jammu and Kashmir High Court quashed Bhat's premature retirement and directed the Government to reinstate him. Later, High Court upheld the single bench verdict and observed, "From the perusal of the record, it is evident the learned single Judge has held that the committee hasn't taken into account the APR's of the writ petitioner-respondent of the years 2009-2015. The APR's of the writ petitioner for the year 2015-16 has been graded 'very good' by the same officer who was the chairman of the committee that recommended retiring the writ petitioner-respondent," The double bench maintained that the decision of retiring the employee wasn't taken according to criteria laid down by Supreme Court. Upon the directions of High Court, General Administrative Department on Wednesday finally revoked the Government Order No. 866.GAD of 2015 dated 30-06-2015 and said that the retired officer is entitled for payment of salary, pension and other service benefits to which he was entitled to in absence of GAD Order No. 866 of 2015. Revocation of order by the General Administrative Department and observations of High Court has finally exposed the then top bureaucrats who were the members of the committee that recommended the premature retirement of KAS officer or other 62 civil servants. Chairman of the committee was former Chief Secretary of J&K and he had graded APR's of KAS officer 'very good'. The conduct of others top bureaucrats who were the members of committee has also not satisfactory as they too were facing serious allegations. Bhat told Early Times that he was punished for standing against land mafia at Sonamarg and construction mafia at Pahalgam. "I demolished 135 structures at Pahalgam and sealed 32 structures besides that stood against land grabbers," he added.
