Jammu, Apr 18: A Division Bench of State High Court Comprising Chief Justice Gita Mittal and Justice Sindhu Sharma extended six weeks time for completion of enquiry in the Niki Tawi Violence case in which the Jammu Development Authority (JDA) team had gone to aforesaid area for removing the illegal structures.
Earlier, a suo-moto Public Interest Litigation (PIL) was registered wherein the DB had appointed 2nd Additional District and Sessions Judge Jammu as Enquiry Officer. Earlier, the DB observed that an interim report dated January 28, 2019 has been received from Virinder Singh Bhou, 2nd Additional District and Sessions Judge, Jammu wherein further time is sought to complete the enquiry in terms of order dated December 28, 2018.
On January 10, in Nikki Tawi violence case the Second Additional District and Sessions Judge Jammu Virender Singh Bhou, who was appointed as Enquiry Officer by the Division Bench of the State High Court had sought details from Deputy Commissioner, Jammu, Vice Chairman JDA, Jammu, Conservator of Forests, Jammu Circle regarding encroachers, the extent of encroachments made by them and dimensions of constructions raised on encroached land, if any, by the encroachers in a tabular form with remarks indicating lapse in execution of Court orders by any officer/officials involved in implementation of Court orders from time to time till the order dated December 22, 2018 was passed.
Enquiry Officer had also directed Chief Engineer PDD, Jammu and Chief Engineer PHE Jammu to furnish details of illegal electric and water connections provided to illegal occupants in the aforesaid localities and follow up action taken by them. Enquiry Officer had also directed SSP, Jammu to furnish details of the follow up action pursuant to court orders issued from time to time in tabular form and pin point lapse, if any, on the part of any officer at the relevant time, and shall furnish more specifically the details of deployment of the force provided to JDA and other allied agencies for implementing the last court order and while implementing the same in which over two dozen people including senior JDA and police officers received injuries.
"It is also deemed expedient to seek details from SSP CID (SB), Jammu about the Government/police employees, who have settled illegally in these localities and have established their structures/houses illegally on JDA/State/Forest land. Chief Engineer PWD, Jammu was also directed to furnish details regarding macadamized road, which has been constructed right from Fourth Tawi bridge reaching up to Beli Charana and onward, whether the same has sanction/approval of the Competent Authority or not in accordance with law", the Enquiry Officer observed. On December 22, over 15 persons, including Station House Officer (SHO) Bakshi Nagar and Vice Chairman, Jammu Development Authority (JDA), had suffered injuries when an irate mob of Gujjars attacked them and pelted stones on them during an anti-encroachment drive at Niki Tawi area near Fourth Tawi Bridge area. Police had also resorted to mild cane charge and fired few tear gas shells to disperse the mob. —JNF
