HC directs state to release funds
Set up 2 eye banks in JK

Jammu, Sept 15 (JNF): The High Court has directed the government to ensure immediate release of funds for  setting up of two  eye banks at Srinagar and Jammu. The directions were passed in two separate PILs by  a  Division Bench comprising First Puisne Judge, Virender Singh and Justice Muzaffar Hussain Attar today.
In the two Public Interest Litigations filed by Smile Social Youth Club of J&K and Advocates namely Rinku Sharma and Ajay Sharma seeking direction to the respondents to establish and run two eye-banks in the State of J&K as so to provide health and medical care to blind population of the state being one of the fact of the right to life as stipulated in Article 21 of Constitution of India.            This significant judgment written by First Puisne Judge Virender Singh for the Division Bench after hearing Advocate Navneet Dubey and Advocate  Rinku Sharma appeared for the PILs whereas Deputy Mrs. Neeru Goswami appeared for the state respondents observed that the affidavit filed by Additional Secretary Health & Medical Education Dept in which he submitted that a some of Rs 2.5 crores approximately is required for establishment of one Eye Bank and for the two banks an amount of Rs 5 Crores approximately be sufficient, is strictly in terms of the order dated August 29, 2012 as it provides complete road map which is necessary for establishing two eye-banks but what appears to the Court is that the Health and Medical Education Dept is running short of funds to meet the requirements. Therefore, the matter is taken-up with planning and development dept for releasing additional funds. In the said back-drop and being conscious of the problems being faced by the patients of J&K State in the absence of any eye-bank, both the Public Interest Litigations invite immediate concern of the Court, has such it becomes imperative to issue direction to the Planning and Development to release additional funds to the health and medical education Dept.        
The court disposed of both the PILs with the direction to the Commissioner/ Secretary to Planning and Development Dept J&K Govt to release the required funds to Health and Medical Education Dept at the earliest, enable it to complete the project for establishing two eye banks at Jammu and other at Srinagar following the road map prepared in this regard, but within the shortest possible time as the matter has already been delayed unjustifiably and disposed of both the PILs with applications.
