CIC had not asked Govt to weaken RTI Law
RTI reply contradicts Govt’s claim

JAMMU, Sept 15: Contesting the claim of the state government that the Chief Information Commissioner (CIC) had asked the state government for dilution of the RTI Rules, the Jammu and Kashmir State Information Commission has formally issued the documents including the CIC’s DO Letter (no. PS/CIC/13/11 Dated: 12/05/11) addressed to Chief Minister and Secretary’s letter (no. SIC/CO/Adm/18/2012/502 DATED 17/04/2012) to GAD. The State Information Commission has officially handed over these documents to the RTI activist Raman Sharma on his RTI application dated September 5, 2012. The Commission’s documents reveal that it has never asked the government to dilute the RTI Rules as have been done by the state government vide issuing SRO no. 279 dated August 30, 2012.
Though the commission has also made some recommendations for amendments in RTI rules to the government through Secretary GAD but these recommendations have nothing to do with the amendments made by the state government.
Earlier facing severe criticism and protests from the Civil Society and RTI activists the state government had tried to shift the blame on the State Information Commission and especially on the Chief Information Commissioner for the amendments. The DO letter dated 12/05/2011  written by the CIC to Chief Minister was just a courtesy letter where the former has thanked the latter for his government’s support and apprised the CM about the total number of appeals and complaints received by it and made a request to remove the disparity between the fees structure in Central RTI Act and JK RTI Act. These RTI revelations have proved that neither the Chief Information Commissioner nor any other member of the Commission have asked the state government to dilute the RTI rules in its present form.  Activist Raman Sharma, who has received these documents under RTI act, has once again requested the Chief Minister to find out the bureaucrats who are misguiding him and his government. Former Central Chief Information Commissioner Wajahat Habibullah has also shot a letter to the State Government for reconsidering its decision to dilute the RTI Rules, that has virtually turned the State Information Commission to a powerless institution which can only pass orders but cannot compel the officers and departments to comply its decisions.
