Court acquits man of murder charges

JAMMU, Sept 15 (JNF) : Principal sessions Judge Kathua MK Hanjura acquitted one Ram Lal s/o Janak Raj r/o Jakh Bar Tehsil Kathua who was facing trial in murder case of one Sanji Ram, and took serious note on the functioning of Investigating Agency that no attempt has been made by the Investigating Agency to find out by any amount of evidence, which could have been gathered, that the bony skeleton was that of the deceased. By a mere statement that wearing Apparels of the deceased were lying near the side of the bony skeleton and it was that of the deceased.
According to the police case that on June 24, 2006 that Sanji Ram s/o Jattu Ram r/o Village Chan Aroria left for Madhopur on June 20, 2006 for fetching of a cart and a horse but he did not return. Police authority swing into the action and all police stations and police posts in the state of J&K were informed about the episode. On June 27, 2006 a skeleton was found lying on the banks of river Ravi within the jurisdiction of P/S Lakhanpur. It was identified to be that of Sanji Ram s/o Jattu Ram, the case was death of the deceased could not been ascertained immediately. Proceedings u/s 174 CrPC were initiated to find out the reason that led to this death. During the proceedings the commission of crime was traced to the accused, accordingly a case u/s 302 RPC was registered at the Police station Lakhanpur. On the completion of the investigation Challan was presented in the Court.
The court after hearing PP Ravi Kumar Gupta for the state whereas Advocate AS Salathia appeared for the accused, took serious note of the investigating agency and further observed that prosecution cannot be said to have discharged the burden beyond any shadow of doubt that the same was that of Sanji Ram A Known post-mortem, blood grouping of an individual serve to narrow the rage of possible identities. The bone-marrow in skeleton remains retains serologically detectable antigens. This test could have been conducted by the Investigating Agency. Age of the fractures on the skull could have been diagnosed by X-Ray, DNA, Profile of Autopsy derived tissues could have been compared by single probe analysis with that of the children and sibling. Nothing in this regard has been done. With these observations Court acquitted the Ram Lal accused from the charges leveled against him for committing murder. JNF
