| Rapist gets 10 years RI, fine | | | early times report
Poonch, Nov 1(JNF): Principal Sessions Judge Poonch Kishore Kumar today awarded ten yrs rigorous imprisonment and fine Rs 50,000 to Altaf Hussain S/O Allah Ditta Caste Qureshi R/O Hari Tehsil Surankote who was facing trial in rape with 13 yrs old minor girl. According to the police case that on June 13, 2006 at about 4 PM she come from the school (Madarsa) to her house and the accused who is also residing adjacent to the house of complainant, had already entered in the house from a window and had kept hidden himself in the house as her father had gone to work in the paddy fields and the accused was aware of her arrival in the house as per routine. The moment she entered in the house, the accused who was already hiding in the house caught hold her and took her to a cattle shed and untied the string of the salwar of the complainant by force and forcibly flung her salwar and committed rape upon her. She tried to raise hue and cry and by the time ,her mother namely Hamida bi reached there and tried to rescue her but accused Altaf Hussain continued to rape her and after the commission of rape accused run away from the spot and went to his house from where he started abusing them in a filthy language.
The victim remained lying in the cattle shed. People came on spot and the members of the biradri asked the family of the complainant to settle their dispute in the bradri Panchayat. They kept them busy for 2 to 3 days and thereafter the compliant is filed. On this report, an FIR No.92/06 for the commission of offence u/s 376 was registered.
After hearing Public Prosecutor Nazir Hussain for the state whereas Advocates Taj Hussain Shah and Iftiqkhar Ahmed Bazmi, Principal Sessions Judge Poonch Mr. Kishore Kumar observed that Women play many roles during various stages of their life as a daughter, wife, mother & sister etc.In spite of her contribution in the life every human being she still belongs to a class that is in disadvantaged position on account of various social, political, & economic barriers and impediments. With these observations Court found accused guilty of offence u/s 376 RPC and sentenced him to undergo rigorous imprisonment for a period of ten years and to a fine of Rs.50000/- under Section 376 RPC. In case of default in payment of fine, accused shall further undergo imprisonment for a period of one year u/s 376 RPC. In case the convict Altaf Hussein deposits the fine, the same shall be paid to the prosecutrix. JNF |
