| Court acquits husband & ors as Police fail to prove case | | Dowry death case | | early times report Jammu, Nov 2 (JNF): Principal Sessions Judge Jammu Jang Bahadur Singh Jamwal has acquitted Husband Raj Kumar S/O Maheshwar Nath, Mother-in-Law Raj Rani W/O Maheshwar Nath R/O H. No. 46, Roop Nagar, Jammu and Sister-In-Law Girija @ Babli W/O Rakesh Kumar R/O Government Quarter, 311, Janipur, Jammu from the charges of dowry death case as police completely failed to prove its case against the accused persons. The prosecution facts are that on 25.04.2010, the police received information from GMCH Jammu that Sunita W/O Raj Kumar is admitted in the hospital in an injured condition. SHO, Police Station, Domana having accompanied Kartar Singh, SGC, Baldev Raj, SPO and Ramesh Lal, SPO went to the hospital and found that the deceased was admitted in the hospital in injured condition with burn injuries. While narrating the sequence of incidents victim stated that she is married to the accused Raj Kumar. The accused having joined together sprinkled kerosene oil on her and the put the fire on. She raised an alarm but nobody came to save her neither her husband, mother-in-law nor sister-in-law, who were present there. They left the place of occurrence and went to a distance. The mother-in-law, sister-in-law and husband used to scuffle with her and had thrown her out seven days prior to the occurrence. She returned today to her in-laws house when her mother-in-law and husband asked whether she has brought Rs. 1.00 lac or not. She replied that she has not brought the same. Her mother-in-law and sister-in-law firstly belabored. Mother-in-law sprinkled kerosene oil on her and sister-in-law lit the fire. She has two children out of which one is female, who is elder than male. Her son's name is Sanjeev. She has left both the children at home. Principal Sessions Judge Jammu Jang Bahadur Singh Jamwal after hearing Advocates K.L. Pandita, Sumir Pandita, Amit P. Sehgal & Manish Sharma for the accused and Public Prosecutor Choudhary Shabir for the State, observed that Court is satisfied that the prosecution has completely failed to prove its case against the accused. The factum of the deceased having burnt more than 98% coupled with the statements of various prosecutions witnesses, defence witnesses and the statements of Doctors, a reasonable and genuine doubt has been created in the story of prosecution. Accordingly, the challan fails and the same is dismissed. Accused are acquitted of the charge. The accused Raj Kumar is in custody and he shall be released from the custody in case he is not detained in any other case. |
