| JSM demands revocation of Art 350-A | | | Early Times Report Jammu, Jan 2: Jammu State Morcha (JSM) asked the Government of India to revoke article 350-A in the Indian Constitution mysteriously and illegally as appendix-II on May 1954 without taking the parliament into confidence. As per press release, the state president of JSM Prof Virender said the article is against the basic structure of the Indian Constitution that guarantees equality to all the citizens of India. The article 35-A paved the way for the Constituent Assembly of Jammu and Kashmir State to incorporate in the state constitution the sections 6, 8, and 9, thereby defining which Indian citizen can be a permanent resident of the state that can enjoy the citizenship rights of the state, he added. He further said these are unique clauses not found in any of the countries throughout the world and violate human rights and the basic rights granted in Indian Constitution. This article which was enforced unconstitutionally needs to go as it is responsible for the discriminatory treatment to the women of the state and the West Pakistan refugees. Women folk of the state are debarred from claiming equality to their counterpart men folk of the state in the matter of their rights as being state citizen. Under the cover of these sections of J&K constitution the Kashmiri leaders are prompted to introduce and pass Anti Women Reservation Bill in the state Assembly. By enforcing the article the problems of West Pakistan refugees have been made perpetual and permanent as they can never be the citizens of Jammu and Kashmir. |
