| DB directs Sarpanch not to exercise any financial as well as administrative power | | | Early Times Report
JAMMU, Jan 2: In a Public Interest Litigation filed by Ashiq Hussain & ors regarding issuance of Job card to Govt Employees, students that too minor and dead person under MNREGA Scheme in connivance with revenue officials. Under this scheme adult of every house hold the right to job card. As per the MNREGA scheme only adult members being of house hold are guaranteed 100 days manual work to check unemployment in rural areas taking undue advantage of their positions, the official respondents has made gross abuse of the process of law by issuing job cards to those who are not eligible having under a conspiracy with Sarpanches and Panches and drawn lacs of rupees on illegal job card. Division Bench of the state High Court comprising Chief Justice MM Kumar and Justice Hasnain Massodi after hearing Adv KS Puri for the PIL whereas Senior Additional Advocate General Gagan Basotra for the state observed that In view of the aforesaid registration of FIR and serious allegations and directed that Sh. Mohd Ayaz who was Sarpanch earlier and continue to function as such shall not exercise any financial as well as administrative power within the meaning of Section 25 of the Jammu & Kashmir Panchyati Raj Act, 1989. The status of other persons named in the FIR be filed by the official respondents in the reply to be filed before next date of hearing. It is worthwhile to mention herein that in the status report filed by SSP VOJ it was stated that there are number of persons who are not eligible and their job cards have been prepared to withdraw the amount. Apart from the fact that eighteen (18) number of work approvals have been taken up by the Panchayat Gurrekrah and out of all executed works ten works have been subjected to inspection. However, as per the inspection report of the Engineering Wing (VO), the executed works have been found either unexecuted or meagerly executed, although full payment has been made. |
