Jammu, Feb 12 (JNF) : In a letter written by Amit Dalia, a social activist regarding constructions of illegal buildings in the Jammu City which include the Master Plan Violations treated as Public Interest Litigation. A Division Bench of State High Court Comprising Chief Justice M M Kumar and Justice Dhiraj Singh Thakur today after gonethrough letter turned PIL observed that representation filed by Amit Dalia, a social activist, Jammu has brought on record various news items published in various newspapers highlighting the constructions of illegal buildings in the City of Jammu which include the Master Plan violations
There is another news item published in the English Daily 'indicating that 166 cases have been registered for illegal constructions for the year 2013-2014. The aforesaid statement was made on the floor of the House by the Urban Development and Local Bodies Minister in a written reply.
Division Bench issued notice Chief Secretary J&K, Secretary to Government Housing and Urban Development Department and Local Bodies, Jammu, Jammu Municipal Corporation through its Commissioner and Jammu Development Authority through its Vice Chairman, Jammu and directed that The respondents shall furnish the details of illegal constructions in respect of all the buildings without confining the data to the year 2013-14. The Municipal Corporation as well as Jammu Development Authority shall furnish the details with regard to the buildings which have been constructed in violations of the Master Plan, without any sanction to the site plans, buildings which have been built on public land or which have been constructed in the lanes/by-lanes left for the public utility.
The data be furnished within four weeks. The respondents shall also point out as to what action has been initiated against the violators and what steps have been taken to confront the illegal construction in brazen disregard to the orders already issued. Division Bench also appointed Sr. Adv R. K. Gupta with Adv Prem Sadotra to assist the Court in these proceedings. Division Bench further observed that this Court being custodia legis of the subject matter no other court, forum or quasi judicial authority shall entertain and decide any matter and directed the Registry to list this PIL on March 18, 2014.
