Jammu, May 16: In a Public Interest Litigation regarding misappropriation of crores of rupees of food grains meant for public in J&K in which 88 employees of Kashmir Division & 57 of Jammu Division allegedly involved, Division Bench of state High Court Comprising Justice Mohammad Yaqoob Mir and Justice Dhiraj Singh Thakur after perusal of the order dated April 1, 2014 observed accused employees were directed to furnish the details of their moveable and immoveable assets in their name, spouse, brother or children names, including the details of their bank accounts along with the details of the moveable and immoveable assets/bank accounts of their spouses and children. Division Bench further observed that only one official namely, . Abdul Rashid Magrey, had filed detailed response. Counsel appearing on his behalf invited attention of the Court towards the details as furnished along with the status report by the respondent-CA&PD Department. At serial No.8 as against said Abdul Rashid Magrey, outstanding amount has been shown as Rs.71,18,704.68 pertaining to the year 2003-04. According to the counsel, said official has remained attached pending enquiry pursuant to order No.153 Dfsk of 1999 dated 16.10.1999 and finally has been dismissed. He was not incharge of any store. He had no chance to commit any embezzlement in the year 2003-04. Counsel has further submitted that the charges, which were earlier labeled against the official, on enquiry, were found incorrect as a result thereof, he has been exonerated. Upon this Division Bench observed that in view of this response filed by said Abdul Rashid Magrey, CA&PD Department shall file its response by or before the next date. Division Bench further observed that the other remaining 87 officials have not responded. It is not known as to whether Secretary to Govt CA&PD Department has issued notices to them and directed Secretary CAPD to publish the list of those officials along with the Court order in newspapers. Division Bench further observed that any further slackness on the part of the Secretary shall be viewed very seriously, which may include his personal appearance as well as imposition of costs and directed and further observed that without any further delay/slackness, Secretary to Govt., CA&PD Department shall ensure filing of requisite status/compliance report by or before the next date of hearing. |
