Court denies pre-arrest bail to cop in rape, fraud case | | | Early Times Report JAMMU, Dec 31: Principal Sessions Judge, Kathua, Vinod Chatterji Koul has rejected the pre-arrest bail application of one Roshan Sharma of Ward No 12, Kathua, who is a police constable serving in IRP 19th Bn against whom FIR No 236/2014 under sections 376 and 420 of RPC was registered by Raj Bagh police station. As per the police report, the accused has committed offences under sections 376 and 420 of RPC. A case against him in this connection stands registered at Rajbagh Police Station. The FIR has been registered on the complaint filed by victim Suman Sharma, whose statement has also been recorded under section 164-A of CrPC. Police requires his custody for the purposes of investigation, which is at initial stage. The judge, after hearing the two sides, observed that in view of the provisions of section 497-C of CrPC as the petitioner is accused of an offence punishable under section 376 of RPC, as such, in view of sub-section (3), provisions of Section 497-A are not available. Therefore, the petitioner's application for grant of bail in the anticipation of his arrest under section 497-A is not maintainable and rejected the pre-arrest bail application. —JNF |
